GravityStream LLC, a Colorado limited liability company doing business as LiquidTrainer (“GravityStream,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy explains what personal information we collect from visitors to liquidtrainer.com (the “Site”) and customers of the LiquidTrainer® product and related services (collectively, the “Services”), how we use it, with whom we share it, how long we keep it, and your rights regarding your personal information.

This Privacy Policy applies to information we collect on the Site, through your purchases, through your account, and through your communications with us. It does not apply to information collected by third parties that we do not own or control, even if linked to from the Site.

By using the Site or our Services, you acknowledge that you have read and understood this Privacy Policy.

1. Information We Collect

We collect the following categories of personal information:

  1. Information you provide directly to us:
    • Account information: name, email address, password, and any profile information you choose to add
    • Order information: name, shipping address, billing address, email address, phone number, and payment information (payment information is processed by our payment processor and is not stored on our servers — see Section 3)
    • Communications: the content of any emails, messages, or other communications you send to us, including warranty claim photos and videos
    • Marketing preferences: your email subscription status and communication preferences
    • Survey or feedback responses: any information you provide if you participate in a survey, review, or testimonial
  2. Information collected automatically when you visit the Site:
    • Device and browser information: IP address, browser type and version, operating system, device type, screen resolution, and language settings
    • Usage information: pages you visit, time spent on pages, links clicked, search terms used on the Site, referring website, and the date and time of your visit
    • Cookies and similar technologies: small data files placed on your device that help us operate the Site and understand how it is used (see Section 6)
  3. Information from third parties:
    • Payment processors: transaction confirmation data (we do not receive full payment card numbers)
    • Shipping carriers: delivery confirmation and tracking data
    • Analytics providers: aggregated information about how visitors use the Site

We do not knowingly collect personal information from children under the age of 13. If you believe we have collected information from a child under 13, please contact us at team@liquidtrainer.com and we will delete the information.

2. How We Use Your Information

We use your personal information for the following purposes:

  • To fulfill orders: to process payments, ship products, communicate about your order, handle returns and warranty claims, and provide customer support
  • To provide and maintain the Site and Services: to operate the Site, deliver the Flo Dynamic Movement System™ and other content you have access to, manage your account, and authenticate your access
  • To communicate with you: to send transactional emails (order confirmations, shipping notifications, account updates) and, with your consent, marketing emails about Products, training content, and promotions
  • To improve our products and services: to understand how customers use the Site, identify and fix problems, develop new features and content, and improve the customer experience
  • To prevent fraud and protect security: to detect, investigate, and prevent fraudulent transactions, unauthorized account access, refund abuse, and other illegal activity
  • To comply with legal obligations: to comply with applicable laws, regulations, court orders, subpoenas, and lawful requests from government authorities
  • To enforce our agreements: to enforce these Terms & Conditions, the Warranty & Repair Policy, the Assumption of Risk & Release of Liability, and any other agreements with you
  • For other purposes with your consent: for any other purpose disclosed to you at the time you provide the information or to which you otherwise consent

3. How We Share Your Information

We do not sell, rent, or trade your personal information to third parties for their marketing purposes.

We share your personal information only in the following limited circumstances:

  1. Service providers. We share personal information with third-party vendors that perform services on our behalf, including:
  • Payment processing (e.g., Stripe or our then-current payment processor) — to process your payment
  • Shipping and fulfillment — to deliver your order
  • Email services — to send transactional and marketing emails
  • Website hosting and infrastructure — to operate the Site
  • Analytics — to understand Site usage
  • Customer support tools — to respond to your inquiries
  • Legal, accounting, and professional services — to operate our business

These service providers are contractually obligated to use your information only to provide services to us and to protect it appropriately.

  1. Legal compliance. We may disclose your personal information when required by law, subpoena, court order, or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
  2. Business transfers. If GravityStream LLC is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our assets, your personal information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have regarding your information.
  3. With your consent. We may share your information for any other purpose with your consent.

4. Legal Bases for Processing (EU/UK Residents)

If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, we process your personal information under the following legal bases:

  • Performance of a contract: to provide the Products and Services you have purchased or requested
  • Consent: for marketing communications, non-essential cookies, and any other purpose where we ask for your specific consent (which you may withdraw at any time)
  • Legitimate interests: to operate and improve our business, prevent fraud, secure the Site, and communicate with customers about our Products and Services, where these interests are not overridden by your rights
  • Legal obligation: to comply with applicable laws, tax requirements, and lawful government requests

5. International Data Transfers

GravityStream LLC is based in the United States, and our service providers may also be located in the United States or other countries outside your country of residence. If you are accessing the Site from outside the United States, your personal information will be transferred to, stored in, and processed in the United States and potentially other countries.

For transfers of personal information from the EEA, the United Kingdom, or Switzerland to the United States, we rely on appropriate safeguards including Standard Contractual Clauses approved by the European Commission, or other lawful transfer mechanisms. By providing your information, you acknowledge this transfer.

6. Cookies and Similar Technologies

We use a limited number of cookies and similar technologies on the Site. We are a U.S.-based business that primarily markets to U.S. customers, and we use cookies for the following purposes only:

  1. Essential cookies. These are necessary for the Site to function, including for cart functionality, login sessions, checkout, security, and load balancing. These cookies do not track you across other websites and cannot be disabled without breaking core Site features.
  2. Analytics cookies. We use Google Analytics to understand how visitors use the Site so we can improve it. Google Analytics collects information such as your IP address, pages visited, time on site, and referral source, and stores identifiable analytics data for no more than fourteen (14) months. Google may also use this information in accordance with its own privacy policy at https://policies.google.com/privacy.

We do not use advertising cookies, retargeting cookies, or social media tracking pixels. We do not sell, rent, or share data collected through cookies with third parties for their marketing purposes.

If we add advertising, retargeting, or social media tracking cookies in the future, we will update this Privacy Policy, provide clear notice on the Site, and obtain consent where required by applicable law.

How to opt out of analytics. You can opt out of Google Analytics in several ways:

  • Install the Google Analytics Opt-Out Browser Add-on at https://tools.google.com/dlpage/gaoptout, which prevents Google Analytics from collecting data on any site you visit
  • Adjust your browser settings to block third-party cookies, clear existing cookies, or use private/incognito browsing mode
  • Enable Global Privacy Control (GPC) in supported browsers, which sends an opt-out signal we honor for California, Colorado, and other applicable residents
  • Email us at team@liquidtrainer.com to request that we exclude your data from analytics, and we will honor that request to the extent technically feasible

Note for visitors from the EU/UK and other regions: GravityStream LLC is a U.S.-based business that markets and sells primarily to U.S. customers. We do not specifically target customers in the European Union, the United Kingdom, or other regions outside the United States and Canada. If you are visiting the Site from outside the United States and wish to prevent analytics tracking, please use one of the opt-out methods above before continuing to use the Site, or discontinue your use of the Site. Continued use of the Site after reading this Privacy Policy constitutes your acknowledgment of our cookie practices.

7. Data Retention

We retain your personal information only for as long as necessary for the purposes described in this Privacy Policy, unless a longer retention period is required by law. Our standard retention practices are:

  • Order and transaction records: retained for seven (7) years from the date of the transaction, to comply with tax, accounting, and warranty obligations
  • Account information: retained for as long as your account is active, plus a reasonable period after closure for legal and operational purposes
  • Customer support communications: retained for up to three (3) years after the matter is resolved
  • Marketing data (email subscription, preferences): retained until you unsubscribe or request deletion, and then deleted from active marketing lists within a reasonable period
  • Site usage and analytics data: retained in aggregated or de-identified form for as long as useful for analysis; identifiable analytics data is typically retained for no more than fourteen (14) months
  • Legal hold: information subject to a pending or anticipated legal claim, investigation, or audit will be retained until the matter is resolved

When information is no longer needed, we either delete it or anonymize it so that it can no longer be associated with you.

8. Your Privacy Rights

Depending on where you live, you may have certain rights regarding your personal information. We respect and honor these rights regardless of where you are located, to the extent practicable.

Rights available to all users:

  • Access — request a copy of the personal information we hold about you
  • Correction — request that we correct inaccurate or incomplete information
  • Deletion — request that we delete your personal information, subject to legal exceptions (for example, we must retain order records for tax purposes)
  • Marketing opt-out — unsubscribe from marketing emails at any time
  • Account closure — request that your account be closed

Additional rights for California residents (CCPA / CPRA):

If you are a California resident, you have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:

  • Right to know what personal information we collect, use, disclose, and the categories of sources and third parties involved
  • Right to delete personal information we have collected from you, subject to legal exceptions
  • Right to correct inaccurate personal information
  • Right to opt out of “sale” or “sharing” of personal information — GravityStream LLC does not sell or share personal information as those terms are defined under California law
  • Right to limit use of sensitive personal information — we do not use or disclose sensitive personal information for purposes that would trigger this right
  • Right to non-discrimination — we will not discriminate against you for exercising your privacy rights

You may submit a verifiable consumer request by emailing team@liquidtrainer.com. We will verify your identity before processing your request. You may also designate an authorized agent to make a request on your behalf, subject to verification.

Additional rights for EU/UK/Swiss residents (GDPR):

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the following rights under the General Data Protection Regulation and related laws:

  • Right of access — receive a copy of your personal information
  • Right to rectification — correct inaccurate or incomplete information
  • Right to erasure (“right to be forgotten”) — request deletion of your personal information
  • Right to restriction of processing — request that we limit how we use your information
  • Right to data portability — receive your information in a structured, machine-readable format
  • Right to object to processing based on legitimate interests, including direct marketing
  • Right to withdraw consent at any time, where processing is based on consent
  • Right to lodge a complaint with your local data protection authority

Additional rights for Colorado residents (CPA):

If you are a Colorado resident, you have similar rights to those described above under the Colorado Privacy Act, including the right to access, correct, delete, and opt out of certain processing of your personal data.

How to exercise your rights:

To exercise any of these rights, please email team@liquidtrainer.com with a description of your request. We will respond within the timeframes required by applicable law (generally 30 to 45 days). We may need to verify your identity before fulfilling your request.

If we are unable to fulfill your request, we will explain why. You have the right to appeal our decision by replying to our response.

9. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, alteration, disclosure, or destruction. These include, where appropriate, encryption of payment information in transit, restricted access to personal information, secure hosting infrastructure, and ongoing security monitoring.

However, no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account password and for any activity that occurs under your account.

If we become aware of a data breach that affects your personal information, we will notify you as required by applicable law.

10. Children’s Privacy

The Site and Services are not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we learn we have collected personal information from a child under 13, we will delete it promptly. Use of the LiquidTrainer® product by children is addressed in the Assumption of Risk & Release of Liability.

11. Third-Party Links

The Site may contain links to third-party websites, services, or content. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party websites before providing them with personal information.

12. Do Not Track

Some browsers offer a “Do Not Track” signal. Because there is no consistent industry standard for how websites should respond to Do Not Track signals, our Site does not currently respond to them. We will continue to monitor developments in this area.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, our Services, or applicable law. When we make material changes, we will update the “Last Updated” date at the top of this Privacy Policy and, where appropriate or required by law, notify you by email or by posting a prominent notice on the Site.

We encourage you to review this Privacy Policy periodically. Your continued use of the Site or Services after the updated Privacy Policy takes effect constitutes your acknowledgment of the changes.
