Product Limited Warranty; Disclaimer of Warranties

PLEASE READ THIS DOCUMENT CAREFULLY. IT DESCRIBES THE LIMITED WARRANTY THAT APPLIES TO YOUR LIQUIDTRAINER® AND THE PROCESS FOR REQUESTING WARRANTY SERVICE.

This Warranty & Repair Policy (“Warranty”) is provided by GravityStream LLC, a Colorado limited liability company doing business as LiquidTrainer (“GravityStream,” “we,” “us,” or “the Company”), to the original purchaser of a LiquidTrainer® product (“you” or “the Purchaser”). This Warranty applies only to the physical LiquidTrainer® product and does not cover training materials, video content, online programs, or services, which are provided as described in the LiquidTrainer® Terms & Conditions.

1. Definitions

For purposes of this Warranty:

  • “Product” means the LiquidTrainer® athletic training device purchased by you directly from GravityStream LLC through liquidtrainer.com.
  • “Accessories” means any item shipped with or sold alongside the Product that is not the LiquidTrainer® device itself, including but not limited to storage bags, racks, replacement valves or caps, fittings, instructional materials, and any third-party item bundled with the Product.
  • “Original Purchaser” means the individual or entity that purchased the Product directly from GravityStream LLC and to whom the Product was first delivered.
  • “Delivery” means the date the Product is received by the Original Purchaser at the shipping address provided at the time of order, as recorded by the shipping carrier.

2. Limited Warranty Coverage

GravityStream LLC warrants that, for a period of sixty (60) days from the date of Delivery (the “Warranty Period”), the Product will be free from defects in materials and workmanship under normal use and proper handling as described in the LiquidTrainer® instructional materials.

This Warranty covers manufacturing defects, including:

  • Seam failures resulting in leakage, where the seam failure is the result of a manufacturing defect and not the result of impact, abrasion, puncture, or misuse
  • Failure of the valve or its attachment to the Product, where the failure is the result of a manufacturing defect
  • Material defects present at the time of Delivery that result in leakage or structural failure under normal use
  • Defects in any factory-installed component of the Product that affect its safe and intended use

If you discover what you believe to be a manufacturing defect during the Warranty Period, follow the claim process described in Section 5 below.

3. What This Warranty Does Not Cover

This Warranty does not cover, and the Company has no obligation under this Warranty with respect to, any of the following:

  1. Damage from normal wear and tear, including gradual material aging, fading, surface scuffing, or minor cosmetic wear that does not affect the Product’s function.
  2. Damage from abrasion, scuffing, or puncture caused by contact with hard or abrasive surfaces, including but not limited to concrete, asphalt, gravel, rough wood, brick, stone, gym flooring, or any other surface that could create pinhole leaks, cuts, or punctures. The LiquidTrainer® is a water-filled training device and is susceptible to puncture and abrasion damage from contact with hard surfaces during use, transport, or storage. Such damage is a result of use conditions, not a manufacturing defect, and is excluded from warranty coverage.
  3. Damage from impact, drops, crushing, being stepped on, run over, or struck by another object.
  4. Damage caused by misuse, abuse, or use inconsistent with the LiquidTrainer® instructional materials, including but not limited to overfilling, underfilling, filling with anything other than water, exposing the Product to chemicals or solvents, or use in any manner the Product is not designed for.
  5. Damage from improper storage or exposure to extreme temperatures, including but not limited to storing the Product in a hot vehicle, leaving the Product in direct sunlight or other high-heat environments for extended periods, exposing the Product to freezing temperatures, storing the Product in contact with sharp or abrasive objects, or any other storage condition that causes material degradation, deformation, or failure. The LiquidTrainer® must not be stored in a vehicle interior, trunk, garage attic, or any other location where temperatures may rise significantly, as heat can damage the material and cause leaks, warping, or failure of the Product or its components.
  6. Damage caused by modification, alteration, or unauthorized repair of the Product by anyone other than GravityStream LLC.
  7. Damage occurring during shipping or handling after Delivery to the Original Purchaser.
  8. Loss or theft of the Product or any component.
  9. Cosmetic differences in color, finish, or appearance that do not affect the Product’s function.
  10. Any Accessory. Accessories are not covered by this Warranty. If an Accessory is defective at the time of Delivery, see Section 6 below.
  11. Products purchased from anyone other than GravityStream LLC, including any third-party seller, reseller, marketplace, auction, or used-goods source. This Warranty applies only to Products purchased directly from liquidtrainer.com.
  12. Products for which you cannot provide proof of purchase from GravityStream LLC, including order number and date of purchase.
  13. Any consequential, incidental, or indirect damages of any kind. See Section 7 below.

4. Reporting Damage at Delivery

You must inspect your Product upon Delivery. If your Product arrives damaged or is missing any item from your order, you must notify GravityStream LLC within fifteen (15) days of Delivery by emailing team@liquidtrainer.com with your order number and a description of the issue, along with photographs of the damage and the shipping packaging if applicable. Failure to report shipping damage or missing items within this 15-day window may result in denial of your claim.

5. Warranty Claim Process

To make a warranty claim during the 60-day Warranty Period:

  1. Contact us within the Warranty Period. Email team@liquidtrainer.com with the following information:
  • Your order number
  • Date of Delivery
  • A description of the issue
  • Photographs and, if possible, a short video clearly showing the defect (for leaks, please show the location of the leak and, where possible, the water exiting the Product)
  1. We will review your claim. Our team will review the information you provide and determine whether the issue is covered under this Warranty. We may request additional information or photographs. We will respond to all warranty inquiries within five (5) business days.
  2. If your claim is approved, we will issue you a Return Merchandise Authorization (“RMA”) number along with return shipping instructions. You must return the defective Product to us within thirty (30) days of receiving your RMA. Products returned without an RMA, or after the 30-day return window, may not be processed.
  3. Our remedy. If your claim is approved and we receive the defective Product within the required window, our sole obligation and your sole remedy under this Warranty is, at our option, to replace the Product with a new or comparable LiquidTrainer® unit of the same size. Replacement units are warranted for the remainder of the original 60-day Warranty Period or for thirty (30) days from the date of replacement shipment, whichever is longer. Replacement does not extend or restart the original Warranty Period.
  4. Shipping. For approved warranty claims, GravityStream LLC will pay outbound shipping for the replacement Product. You are responsible for return shipping of the defective Product unless we instruct otherwise.
  5. Denied claims. If we determine that the issue is not covered by this Warranty (for example, damage from abrasion against hard surfaces, exposure to excessive heat, misuse, or normal wear and tear), we will notify you and explain the basis for the denial. You may at that time elect to purchase a replacement Product at standard pricing.

6. Accessories

GravityStream LLC does not warrant any Accessory. If an Accessory shipped with your Product is defective or missing at the time of Delivery, you must notify us within fifteen (15) days of Delivery as described in Section 4, and we will at our discretion replace or refund the Accessory. After the 15-day Delivery inspection window, Accessories are not covered.

7. Disclaimer of Other Warranties; Limitation of Liability

THIS LIMITED WARRANTY IS THE ONLY WARRANTY APPLICABLE TO THE PRODUCT. To the maximum extent permitted by applicable law, GravityStream LLC disclaims all other warranties, whether express, implied, or statutory, including but not limited to any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. Any implied warranty that cannot lawfully be disclaimed is limited in duration to the 60-day Warranty Period. No oral or written information or advice given by GravityStream LLC or its representatives shall create a warranty or expand the scope of this Warranty.

In no event shall GravityStream LLC or its members, managers, officers, directors, employees, agents, contractors, affiliates, or licensors (collectively, “Company Affiliates”) be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages of any kind, including but not limited to damages for personal injury, property damage (including water damage to flooring, carpet, furniture, electronics, or any other property), lost profits, lost data, loss of use, or any damages arising from your use of the Product or any failure of the Product, even if GravityStream LLC has been advised of the possibility of such damages.

The total cumulative liability of GravityStream LLC and the Company Affiliates to you under this Warranty, for any and all claims of any kind arising out of or in connection with the Product, shall not exceed the amount you actually paid GravityStream LLC for the specific Product giving rise to the claim.

Nothing in this Warranty limits or affects the separate Assumption of Risk & Release of Liability that applies to your use of the Product, which contains additional protections and which is incorporated by reference into this Warranty.

This Warranty gives you specific legal rights. You may also have other rights that vary by state, province, or country. Some jurisdictions do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

8. Geographic Coverage

This Warranty applies to Products purchased and delivered within the United States, Canada, and other countries to which GravityStream LLC ships, as listed at liquidtrainer.com at the time of purchase. International warranty claims may be subject to additional shipping arrangements, customs requirements, and timing differences, and the customer is responsible for any import duties, taxes, or fees on replacement Products shipped internationally. GravityStream LLC reserves the right to require international customers to coordinate replacement shipments in a manner consistent with applicable customs and shipping regulations.

9. Transferability

This Warranty extends only to the Original Purchaser of the Product from GravityStream LLC and is not transferable. The Warranty does not apply to Products that have been resold, given, gifted (other than as a direct gift purchase made through liquidtrainer.com and shipped directly to the recipient), or otherwise transferred to a person other than the Original Purchaser.

10. Severability

If any provision of this Warranty is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

11. Governing Law and Dispute Resolution

This Warranty is governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to this Warranty shall be resolved exclusively in accordance with the dispute resolution provisions set forth in the LiquidTrainer® Terms & Conditions, which are incorporated by reference into this Warranty.
